On July 14, 2021, the Parliament adopted Draft Law #5068, "On Amendments of Certain Laws of Ukraine regarding the Procedure for Election (Appointment) of Members of the High Council of Justice and Activities of Disciplinary Inspectors of the High Council of Justice" (Draft Law).
The Draft Law provides for restarting the High Council of Justice (HCJ) with the participation of international experts, who will have the casting vote. It also reviews the HCJ members' integrity and changes the procedure for bringing judges to disciplinary responsibility.
Members of Parliament took into consideration the proposals of AmCham Ukraine member companies and the recommendations of the Venice Commission aimed at ensuring the proper formation and operation of the Ethics Council, one-time evaluation of existing members of the HCJ, and election (appointment) of new ones.
The American Chamber of Commerce in Ukraine welcomes the adoption of Draft Law, taking into account the business community's proposals. We expect that the President will not delay the signing of respective Laws following the adoption of Draft Laws #5068 and #3711-d for their prompt successful implementation and renewal of citizen's and investor's confidence in the judicial system of Ukraine.
