Policy Progress: Parliamentary Committee on Financial Issues, Tax and Customs Policy Supported AmCham Proposals to Draft Law #5420

Parliamentary Committee on Financial Issues, Tax and Customs Policy (the Committee) issued an official conclusion to Draft Law #5420 amending the Criminal Code of Ukraine and the Criminal Procedure Code of Ukraine regarding the criminalization of smuggling of goods and excisable goods as well as the unreliable declaration of goods.

AmCham Ukraine members’ experts addressed concerns regarding proposed draft amendments. In particular, the need for significant reconsideration of amendments to the rules on criminal liability for smuggling of goods / inaccurate declaration and changes to the legislation on administrative liability for violation of customs regulations. However, we support introduction of criminal liability for tobacco products smuggling in significant amounts.

The Committee supported the AmCham Ukraine concerns and position regarding reconsideration of the draft legislative initiative. We want to thank Anton Melnyk, Chamber Customs Committee Co-Chair, EY Ukraine, and all AmCham Ukraine members who were actively involved in this advocacy process for their contribution. We will continue our work on the improvement of legislation aimed at combating smuggling and the shadow economy.
