CMS Advises KEXIM on Financing for Ukrainian Grain Port Terminal

International law firm CMS Cameron McKenna Nabarro Olswang has advised the Export-Import Bank of Korea (KEXIM), an export credit bank from South Korea, on extending its secured USD $36 million financing to Grain Terminal Holdings in Ukraine.

Grain Terminal Holdings is a Singapore-based joint venture between Posco International (Korea's largest trading company) and the Orexim Group (the leading agricultural trans-shipment and exporting company in Ukraine) that operates the Ukrainian “MMW” grain terminal in Mykolaiv, Ukraine.

CMS’s role advising KEXIM is a testament to the firm’s excellent reputation acting on high-profile financings in the agriculture and infrastructure sectors in the Black Sea region. CMS Cameron McKenna Nabarro Olswang regularly advises on commodity financings in these sectors and has cutting-edge expertise in finding the right solutions for various types of financing in international trade transactions. The firm has several decades of experience acting on both secured and unsecured financings in CEE and across other jurisdictions.

CMS partner Elitsa Ivanova said: “We are delighted to have supported our client KEXIM on the successful extension of its financing deal to Grain Terminal Holdings. This transaction demonstrates our ability to apply innovative legal structures that enable our clients to offer optimal financing solutions to businesses, especially in the agriculture sector.”

The CMS team was led by Elitsa Ivanova and Orest Matviychuk on English-law issues, and Ihor Olekhov on Ukrainian-law issues, together with Ivan Pshyk and Iryna Kravchenko (Kyiv), Daniel Tan and Eric Lai (Singapore) and Katerina Hristova (Sofia).
