CMS Advises FAS Energy on Acquisition of Solar Power Plant in Kyiv Region

International law firm CMS Cameron McKenna Nabarro Olswang in Kyiv has advised FAS Energy on the acquisition of a solar power plant being developed in the Kyiv region, with an expected capacity of 112MW, from a Ukrainian developer. This marks FAS Energy’s second major investment in Ukraine.

CMS acted on all aspects of the transaction, including as Ukrainian and English law counsel in connection with various aspects of project implementation, construction, and merger clearance as well as the transaction documents.

The core CMS team included Managing Partner Vitaliy Radchenko (EPC), Senior Associate Mariana Saienko, and Associate Ihor Pavliukov (both Corporate).

Partner Olga Belyakova (Competition) advised on the procedure for obtaining the required clearance for the transaction with the support of Senior Associate Mykola Heletiy (Competition).

Established in 2013, FAS Energy is the renewable energy subsidiary of Fawaz AlHokair Group and provides renewable energy solutions across the Middle East and internationally.

Vitaliy Radchenko, Managing Partner of CMS in Kyiv, comments: “This is a significant transaction and a strong indicator of the investment community’s confidence in Ukraine (even in times of martial law) and a gradual recovery of its M&A activity. We are pleased to have supported FAS Energy on their second major investment in Ukraine and look forward to watching their continued growth and further expansion.”
