Asters successfully defended leading foreign chemical producers and Ukrainian importers in two safeguard investigations against imports of fertilizers – "Certain Nitrogen Fertilizers" and "Complex Fertilizers" – into Ukraine.
The investigations were launched back in August 2019 following the complaints of the national players claiming that the import of fertilizers increased and caused serious injury to the Ukrainian domestic industry. The Interdepartmental Commission on International Trade supported our clients' position, established that the application of safeguard measures is contrary to the national interests of Ukraine and decided not to implement the safeguard measures.
Asters' International Trade team working on the project consisted of associates Tetiana Bebik and Yelyzaveta Herasymchuk, counsels Anton Sintsov and Olesia Kryvetska led by partners Gleb Bialyi and Alexey Pustovit.
Asters has one of the most dynamic and established practices in international trade in the country. Asters International Trade team represented defense in 8 out of 9 trade investigations initiated by Ukraine in 2019. Asters International Trade practice is top-tiered in Ukraine according to The Legal 500 (2020 edition), one of the most authoritative independent international rankings of legal services providers.
