Anzhelika Livitska Contributes to Improvement of Ukrainian Environmental, Construction, and Subsoil Laws

Asters' Counsel and Head of Construction, Environmental Protection and Sustainable Development Anzhelika Livitska and other experts joined relevant committees of the European Business Association (EBA) and the Confederation of Builders of Ukraine (CBU) in their work to develop laws introducing deregulation measures for the martial law period and for the period of restoration and rebuild of Ukraine.

As a legal adviser to the EBA's Committee on Industrial Ecology and Sustainable Development, Anzhelika prepared a number of legal opinions on relevant bills and regulations, in particular:

  • Bill No. 7331 on business deregulation
  • a position paper on submitting а declaration to obtain approvals during the martial law period
  • Bill No. 6544 introducing a model of sustainable consumption of natural resources and products
  • a draft position paper on collecting and using proceeds from the CO2 emission tax

As part of the joint initiatives of the Ministry for Communities and Territories Development of Ukraine and the CBU, the experts prepared and provided a rationale for amending the legal regulation of construction, spatial planning, ecology, critical imports, and other issues, including:

  • the Government's resolution amending the Procedures for approval and expert assessment of construction projects
  • a priority action plan to manage the consequences of the armed aggression of the Russian Federation related to damage caused to buildings and structures
  • amending the Procedures for conduct of inspections of construction projects commissioned for operation

These legislative initiatives will help to jump start the economy, the construction industry, and the production of construction materials after the war ends.
