Policy Win: The Law #4630-IX on Reservation of Employees and New Conditions of Employment Contracts for Defense Industry Enterprises Was Signed by the President of Ukraine

The American Chamber of Commerce in Ukraine welcomes the signing of Law #4630-IX "On Amendments to Certain Legislative Acts of Ukraine regarding Organization of Labor Relations under Martial Law" (the Law) by the President of Ukraine.

In accordance with the Law, enterprises, institutions, and organizations classified as critically important for meeting the needs of the Armed Forces of Ukraine, other military formations, ensuring the functioning of the economy, and maintaining the livelihood of the population during a special period in the defense industry sector are granted the right to reserve newly employed military liable workers for a period of up to 45 calendar days from the date of conclusion of the employment contract.

Such reservation may be applied regardless of the availability or proper execution of military registration documents of the respective employees.

Within the specified period, employees will be able to safely correct the violations, if any, and subsequently be reserved for a longer term on general grounds.

For such employees, a shortened probation period of 45 days is established upon employment, and the employer is entitled to terminate their employment if they fail to bring their military registration documents into compliance with the requirements of the law within this period.
