On December 15, 2023, the National Energy and Utilities Regulatory Commission (NEURC) published the results of the open discussion of the Draft Resolution "Procedure for the Functioning of Insider Information Platforms" (Draft Resolution). Proposals of the American Chamber of Commerce in Ukraine (AmCham) on this Draft Resolution were partially taken into account. The implementation of the regulatory act will positively affect the achievement of the goals of state regulation, ensure the improvement of the processes taking place on the natural gas and electric energy markets, in particular, determine the requirements for the functioning of insider information platforms and the requirements for the publication (disclosure) of insider information.
AmCham member companies' experts were actively involved in the process of drafting this NEURC regulatory initiative. At the same time, the business community's position was not fully taken into account because of the decision to separate some parts of the Draft Resolution into another document.
Therefore, AmCham looks forward to effective cooperation with the NEURC to further improve the next document so that Ukrainian legislation will comply with the regulations of the European Union regarding the integrity and transparency of the wholesale energy market.
