The American Chamber of Commerce in Ukraine welcomes passing the Draft Law #13335 "On Amendments to Certain Legislative Acts of Ukraine regarding Organization of Labor Relations under Martial Law" (Draft Law) in the first reading.
The Draft Law introduces important changes to the legislation governing labor relations during martial law. In particular, the initiative regulates the procedure for reserving conscripted employees at critical enterprises of the defense-industrial complex, clarifies the conditions for concluding employment contracts, establishes specifics of probation periods, and outlines the grounds for termination of employment relations.
Experts of the Chamber member companies support the improvement of legal mechanisms aimed at ensuring uninterrupted operation of critical enterprises during wartime, while preserving labor rights and enabling business continuity.
Chamber member companies’ experts previously expressed their support for this Draft Law and submitted proposals to extend the initiative to all critical enterprises, along with other recommendations on its wording.
AmCham Ukraine expresses gratitude to all responsible stakeholders for the open dialogue and constructive engagement during the preparation and consideration of the Draft Law. We consider this as an important step towards taking into account the business community’s position on pressing issues related to employees’ deferment and look forward to continued constructive cooperation and the consideration of business needs and proposals in the course of Draft Law’s preparation for the second reading.
