AmCham Ukraine welcomes the adoption of the NBU Board Resolution #53 “On Amendments to NBU Board Resolution #18 dated February 24, 2022” (Resolution).
With this Resolution, the following currency liberalization measures take effect:
- the limit for financing foreign representative offices of Ukrainian companies abroad has been increased
- payments to settle registration, arbitration, court fees, and other costs related to enforcement proceedings regarding non-residents' non-compliance with import and export contracts have been permitted
- limits on payments by corporate cards abroad have been increased
In addition, the NBU is implementing stimulating currency liberalization, allowing FX transactions above the established currency restrictions within the investment limit in the amount of funds, invested from abroad in foreign currency into the authorized capital of Ukrainian enterprises from May 12, 2025.
The transactions include:
- payment for the import of goods delivered before February 23, 2021
- refund for non-resident buyers of prepayment for goods made before February 23, 2022
- fulfillment of debt obligations on “old” foreign loans received before June 20, 2023
Experts of AmCham Ukraine member companies have consistently emphasized the necessity of the relaxation of foreign exchange and currency control regulations to help improve the business climate in Ukraine. AmCham Ukraine member companies believe that the gradual introduction by the National Bank of an approach that highlights incentives over prohibitions and restrictions will help retain foreign currency within Ukrainian banks to facilitate cross-border transactions and other settlements worldwide via Ukrainian banks and financial institutions.
