On November 22, 2024, the Cabinet of Ministers of Ukraine (CMU) adopted Resolution #1332 “Certain Issues of Conscripts' Reservation for the Period of Mobilization and Wartime”, which amends the CMU Resolution #76 “Certain Issues of Implementation of the Provisions of the Law of Ukraine "On Mobilization Training and Mobilization" regarding Conscripts’ Reservation for the Period of Mobilization and Wartime”.
Among the key provisions introduced by the Resolution #1332 are the following:
1. deferrals from conscription during mobilization are valid for the period for which they are granted but not longer than February 28, 2025
2. the validity of the critical enterprises’ status, which expires by November 30, 2024, is extended until December 31, 2024
3. sectoral and regional criteria for the critical status of the enterprise will be approved by the Ministry of Economy of Ukraine and the Ministry of Defense of Ukraine
4. monitoring of enterprises will occur quarterly; if requirements are violated, the critical status may be revoked
5. two mandatory criteria for recognizing an enterprise as critical are introduced as follows:
- the enterprise has no debts on payment of taxes and single social contribution
- the salary of an employee booked by the enterprise constitutes at least 2.5 minimum wages
Experts of the AmCham Ukraine Human Capital Committee have advocated for the resumption of the reservation procedure through the “Diia” portal and renewal of the critical status provision and confirmation for the enterprises.
We hope that the introduced changes and new criteria for conscripts’ reservation and critical status provision will ensure a balanced and clarified approach to the reservation procedure.
