Sayenko Kharenko Represented ArcelorMittal Kryvyi Rih in the US Steel Sunset Review

Sayenko Kharenko’s international trade team, in collaboration with Appleton Luff (Washington, D.C.), has represented ArcelorMittal Kryvyi Rih in a sunset review of anti-dumping duties on steel concrete reinforcing bar imports to the United States. The review encompasses imports from Ukraine, Belarus, China, Indonesia, Latvia, Moldova, and Poland.

The legal team provided comprehensive support throughout the review process, including strategic advice on questionnaire submissions and representation at hearings. This initiative comes at a particularly significant time in US-Ukraine trade relations, following Ukraine’s formal inquiry during the December 2022 WTO Trade Policy Review about the possibility of terminating anti-dumping measures due to changed circumstances in Ukraine.

While the US indicated no automatic termination of duties, they encouraged Ukrainian producers to pursue individual reviews. This approach has shown promise, as demonstrated by Sayenko Kharenko’s recent groundbreaking success in representing PJSC Stalkanat. In that historic case, Sayenko Kharenko and Appleton Luff secured an unprecedented 0% dumping margin rate, down from 19.03%. This case marked the first time a Ukrainian company achieved a zero dumping margin in a US trade review.

However, despite strong grounds for duty termination in the current ArcelorMittal case, the review coincided with the election of Donald Tramp as the US President and the predictable shift in the US trade policy under the new Trump administration to apply import tariffs and protect the US market.
