Traditionally high emotional rate, intrinsic to a labour dispute, increases with the termination of an employment contract with a director, sales manager, commercial director, or another employee authorized to make management decisions.
The difficulty of managers' and top managers' dismissal is also exacerbated by current labour legislation, which does not conform to today's realities and protects primarily employee's but not employer's interests.
At the webinar, we thoroughly outlined the legal grounds and regulations on dismissal of managers and recent court rulings in labour disputes with top managers.
The speakers also shared court cases from their own practice and provided practical advice to employers on how to prevent violations in the dismissal of managers. Participants had an opportunity to discuss the following questions:
- Termination of powers of officials as a ground for dismissal
- Dismissal on the grounds provided in the contract: how to fill out correctly?
- Agreement of the parties and voluntary resignation: what are the risks?
- Other grounds for dismissal of top managers under the current legislation
- The last key positions of courts in labour disputes
