Despite the fact national customs legislation is largely based on international one and is being approximated to leading jurisdictions every year, the customs sphere is a point of no less concern for businesses.

This year, the National Reform Council has already presented the customs reform concept aimed at achieving a real service culture, which clearly shows public interest in changes at the border.

The Business Ombudsman Council, regularly dealing with customs related complaints, has developed quite a large number of systemic recommendations reflected, in particular, in its Systemic Report "Main Problems Faced by Business In Customs Sphere".

At the same time, we would like to note, in many cases the problem lies not in regulation, but in law enforcement, when the purpose of filling the budget distorts the objective perception of both legislation requirements and position of enterprises.

At our webinar, we tried to outline the main approaches to consideration of customs related complaints and gave advice on protecting business rights.

In particular, we considered:

  • What to do when the customs clearance is unreasonably delayed?
  • Determination of customs value: how to prove the real price and refund overpayments?
  • Intervention of law enforcement bodies in the customs inspections
  • Changing the ideology of customs control: post-customs audit

Speaker:
Kyrylo Nominas, the Business Ombudsman Council investigator, is an expert in customs, tax and criminal law. Kyrylo represents the Business Ombudsman Council at the Council's joint expert group with the State Customs Service of Ukraine. Before that Kyrylo worked for Sokolovskyi & Partners Law Firm for over 9 years where he specialized in resolving tax disputes and criminal cases. In 2008, Kyrylo graduated from law department of the National Taras Shevchenko University of Kyiv.
