BDO in Ukraine on the Electronic Booking System. Key Aspects of Implementation

Lawmakers keep making changes to the legislation on employee booking. As we have already informed, starting from July 2024, certain employers will be able to book their employees through the Unified State Web Portal of Electronic Services (the Diia portal) in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 650 dated 05.06.2024 (hereinafter — Resolution No. 650). 

There are certain nuances though.

Therefore, we would like to inform you about another legislative innovation, according to which certain employers are obliged to submit new information to the Pension Fund of Ukraine (hereinafter — the PFU).

Below is a summary of the information in question and how it should be submitted.

Public authorities, other state bodies, local governments, enterprises, institutions and organizations that are critical to meeting the needs of the Armed Forces and other military formations during the special period and that are critical to the functioning of the economy and the livelihoods of the population during the special period, — no later than the next day after

  • hiring an employee
  • transfer from one structural unit to another or transfer to another permanent position or job
  • dismissal
  • reinstatement
  • temporary termination / renewal of an employment contract

shall submit to the Pension Fund the relevant information through the Pension Fund’s electronic services web portal in electronic form with the obligatory  electronic signature based on a qualified electronic signature certificate (subparagraph 3, paragraph 3 of Resolution No. 650).

Pursuant to the Resolution No. 650, the information will have to be submitted in respect of employees aged 17 to 60.

Below, we outline the reasons for submitting such information.

The information is submitted in real-time for booking employees for military service according to the list of persons liable for military service during martial law in electronic form, i.e., through Diia.

The Pension Fund of Ukraine and the Ministry of Defense of Ukraine were instructed to ensure electronic information interaction between the register of insured persons of the State Register of Compulsory State Social Insurance and the Unified State Register of Conscripts, Persons Liable for Military Service and Reservists regarding employees of entities, institutions and organizations specified in subparagraph 3 of paragraph 3 of Resolution No. 650, aged 17 to 60, and their positions in real time for the purpose of registration of reservists in the list of persons liable for military service during martial law.

Thus, the Pension Fund of Ukraine must ensure, within one month from the date of entry into force of the Resolution, the technical possibility for public authorities, other state bodies, local self-government bodies, entities, institutions and organizations that are critical to meeting the needs of the Armed Forces, other military formations during a special period, entities, institutions and organizations that are critical to the functioning of the economy and ensuring the vital activity of the population during a special period, to file with the Pension Fund of Ukraine through the web portal electronic applications for military service.

Therefore, we are waiting for this opportunity to be realized on the Pension Fund’s e-services web portal.
