The American Chamber of Commerce in Ukraine welcomes decision of the Parliamentary Committee on Agrarian and Land Policy to adopt as a basis the alternative Draft Law #6070-1 “On Amendments to Certain Laws of Ukraine regarding Implementation of Technical Regulation Functions in the Sphere of the Agro-Industrial Complex and Mechanical Engineering for the Agro-Industrial Complex” (hereafter – Draft Law #6070-1) and calls on the Members of Parliament to vote for it. This Draft Law was included into the agenda of the Verkhovna Rada of Ukraine on November 30, 2021.
Currently, the certification procedure for new types of agricultural machinery is blocked, as institutions that were authorized to provide conformity assessment of agricultural machinery have lost their accreditation, inter alia the following state enterprises: “Ukrainian State Center for Testing and Forecasting of Machinery and Technologies for Agricultural Production” and Scientific and Technical Certification Center “AGROSEPRO” of the National Academy of Agrarian Sciences of Ukraine.
This situation creates numerous risks for business, such as halting sales of new types of agricultural machinery; limiting farmers' access to the innovative models; eliminating the relevant revenues to the state budget of Ukraine.
Draft Law #6070-1 is aimed to regulate on the legislative level the issue of conformity assessment bodies functioning in line with requirements provided by the Technical Regulation on the type of agricultural and forestry tractors, their trailers and replaceable trailers, systems, components, and individual technical units. This Draft Law will unblock certification of new types of agricultural machinery by providing the relevant Ministry with respective powers without significant changes in the conformity assessment procedure.
Thus, experts of the Chamber Working Group on Agricultural Machinery Issues support the Draft Law #6070-1 and call on Members of Parliament to adopt it as soon as possible.
