Sayenko Kharenko’s international trade practice has successfully represented the interests of LLC “Ascania-Flora” in the safeguard investigation related to imports of fresh cut roses notwithstanding country of origin and export. The investigation was initiated at the request of LLC “Ascania-Flora”.
Sayenko Kharenko legal services included, inter alia, preparation of the request for initiation of the safeguard investigation, preparation of the answers to the questionnaire, drafting different commentaries, representing the client at the hearings, etc.
Upon the results of the investigation, Sayenko Kharenko has successfully proved the necessity to apply safeguard duties at the rate of 56 per cent initialy for 3 years. This case is unique for Ukraine because of high safeguard duty rate that indeed allows eliminate serious injury caused to the domestic industry by surge imports and efficiently to adapt to the new conditions of competition.
