Policy Win: Cabinet of Ministers of Ukraine Updated Employees Reservation Rules to Support the Defense Industry Workforce Potential

The Cabinet of Ministers of Ukraine, by Resolution #1608 of December 8, 2025, introduced amendments to Resolution #76 of January 27, 2023, “Certain Issues of Implementing the Provisions of the Law of Ukraine “On Mobilization Preparation and Mobilization” regarding the Reservation of Military Liable Persons for the Period of Mobilization and Martial Law” thereby improving the regulatory framework governing the reservation of military liable persons.

AmCham Ukraine has consistently emphasized the need to improve the mobilization deferment procedure in order to ensure business continuity. Therefore, we welcome the Government’s decision, recognizing its importance for critically important enterprises.

Under the updated procedure, defense-industrial complex (DIC) can now reserve employees for up to 45 calendar days. During this period, workers have the opportunity to correct any discrepancies related to military registration, allowing companies to retain essential specialists without interruption while formalities are resolved.

Additionally, enterprises recognized as critically important are no longer subject to the previous 72-hour waiting period for verification of employee reservation lists. This adjustment accelerates decision-making, helping companies promptly maintain their workforce and ensure business continuity.

The updated rules take effect from the date of official publication.
