Restriction of the work of a certain list of business entities for the duration of the quarantine.
Novelties of legislation:
1. On 16 March 2020 the Cabinet of Ministers of Ukraine (hereinafter - CMU) extended the list of prohibitions and restrictions related to quarantine[1]. Thus, the prohibition during quarantine (in advance from March 17 to April 3, 2020) fell the following activities:
- catering establishments;
- shopping and entertainment centers and other leisure facilities;
- fitness centers;
- cultural institutions;
- establishments of retail and consumer services.
Keep working
Retailers:
- food trade;
- fuel material;
- hygiene products;
- medicines;
- medical devices;
- means of communication.
Institutions of banking and insurance activities.
Trading and catering activities can be carried out using order delivery if staff is provided with personal protective equipment.
NB! Notwithstanding the prohibition of passenger carriage by road and rail (except in certain cases), freight traffic is not restricted in any way.
2. Municipal administration also imposed additional restrictions. For example, restrictive measures were also introduced in the territory of Kyiv[2]. The term for their introduction is tentatively from March 17 to March 31, 2020. As a result, the work in Kyiv is as limited as possible:
- catering establishments (fast food establishments, restaurants, cafes, bars, including at gas stations);
- markets and agricultural fairs;
- all commercial establishments, including construction materials (except grocery and hardware stores (departments), pharmacies);
- hotels, hostels.
The work was also temporarily suspended:
- entertainment facilities;
- sports complexes;
- pools;
- museums;
- libraries;
- public services institutions.
Catering establishments remain available for courier delivery and pick-up, and only grocery and household departments and/or shops and pharmacies can continue to work in a commercial establishments.
3. Law No. 530s of COVID-19 provides for changes in legislation regarding liability for violation of the quarantine regime. So, the above Law provides for administrative (fines for citizens up to 34 thousand hryvnias, for civil servants 170 000 hryvnias) and criminal liability (from 17 000 to 51 000 hryvnias or arrest for up to six months or restriction of freedom or imprisonment for up to three years).
