ADER HABER Law Firm successfully protected the interests of JSC Ukrnafta as the initiating creditor in the bankruptcy case of PJSC NPK-Halychyna.
Case Overview:
On 26 December 2023, the Commercial Court of Lviv Region opened bankruptcy proceedings against PJSC NPK-Halychyna (Drohobych Oil Refinery) based on the application of JSC Ukrnafta, the debtor's largest creditor, with claims exceeding UAH 14.5 billion.
On 25 June 2026, after two and a half years of litigation, the court declared PJSC NPK-Halychyna bankrupt and opened liquidation proceedings — one of the largest such cases in Ukraine in terms of claims and asset value. The debtor's assets will now be sold at a public auction on Prozorro.Sale, enabling Ukrnafta to satisfy its creditor claims.
Complexity of the Case:
The debtor's management obstructed the asset manager and creditors, prompting the court to remove it from control. Ukrnafta's former shareholders filed unsubstantiated claims exceeding UAH 3.4 billion, while certain creditors attempted to artificially delay the proceedings.
ADER HABER's Role:
The ADER HABER team provided full legal support throughout every stage of the case. The firm's lawyers:
- secured the seizure of more than 70 of the debtor's assets immediately after proceedings opened
- achieved recognition of Ukrnafta's claims worth UAH 14.5 billion and the rejection of unsubstantiated claims by former shareholders worth UAH 3.4 billion
- secured the removal of the debtor's management, enabling completion of the asset valuation (exceeding UAH 2.7 billion)
- supported the filing of claims against the debtor's debtors to recover receivables worth more than UAH 1 billion
- secured the rejection of creditors' attempts to delay the proceedings
Thanks to the work of the ADER HABER Law Firm, Ukrnafta obtained a legal mechanism for debt recovery - the sale of the debtor's assets at public auction.
