In October 2024, the Office of the Prosecutor General submitted a request to France for extradition as part of proceedings investigated by NABU. On October 29, 2025, the Paris Court of Appeal refused to grant extradition.
During the extradition proceedings, approximately 10 court hearings were held. The court examined in detail Ukraine's compliance with its international human rights obligations and the impact of the war on the legal and prison systems.
As part of the case, the Ukrainian side twice provided and detailed guarantees to ensure the rights of the individual, which is in line with the state's practice in extradition cases.
The French court concluded that extradition would violate Article 6 (right to a fair trial) of the European Convention on Human Rights.
In its ruling, the court stated that: “...it cannot be concluded that the party requesting extradition is capable of guaranteeing that Konstantin Zhevago will appear before a court that will ensure fundamental procedural guarantees and the protection of human rights.”
This is the second time that the French judiciary has refused to extradite Konstantin Zhevago to Ukraine. Previously, the court had already refused extradition as part of an investigation by the State Bureau of Investigation.
