ADER HABER Law Firm successfully defended the interests of LLC "Karpaty Mineral Waters" - a leading Ukrainian FMCG manufacturer of non-alcoholic beverages - in a case concerning an alleged violation of legislation on protection against unfair competition.
Case Background
The investigation was initiated following a consumer complaint regarding the alleged non-compliance of the client’s product labelling with the requirements of Ukrainian law.
The situation was complicated by the regulator’s strict position and the need to balance procedural timelines with the client’s operational business processes.
Defence Strategy before the Antimonopoly Committee of Ukraine
The ADER HABER team applied an active procedural defence strategy already at the investigation stage before the Antimonopoly Committee of Ukraine (AMCU).
The lawyers developed a comprehensive evidentiary basis and ensured legal arguments that took into account both competition law requirements and the specifics of the client’s business model.
