Arzinger's White Collar Crime team has successfully represented a major renewable energy investor in the process of lifting the attachment of its property. In particular, 56,320 photovoltaic cells that were necessary for the operation of a solar power plant were released from attachment.
With the developed and effectively implemented defence strategy, the investigating judge supported the arguments that the pre-trial investigation authorities had no factual evidence that the company/its officials had committed any criminal offense. Therefore, the prosecutor's stated purpose of attaching the company's property was in no way justified, and the further effect of the mentioned remedy in the criminal proceedings had no normative or factual substantiation.
