Policy Win: Parliament Provided for the Right of Casting Votes of International Experts while Adopting Draft Law #3711-d

On June 29, 2021, the Parliament adopted Draft Law #3711-d "On Amendments to the Law of Ukraine "On the Judiciary and the Status of Judges" and Some Laws of Ukraine on Resumption of the High Qualifications Commission of Judges of Ukraine" (Draft Law).

The Draft Law is designed to renew the judicial system of Ukraine by restarting the High Qualifications Commission of Judges of Ukraine (HQCJ).

The members of Parliament took the proposal of AmCham Ukraine member companies into consideration and provided for the right of casting votes of international experts in decision-making by the Selection Commission.

We believe that such a decision will contribute to the formation of a reliable and professional HQCJ composition, which will benefit from public confidence.

We are waiting for the official publication of the adopted Law and hope that mentioned approach will be reflected in its text.

At the same time, the Draft Law leaves the final decision on the selection of a person as a member of the HQCJ to the unreformed High Council of Justice (HCJ).

The American Chamber of Commerce in Ukraine calls upon adoption of Draft Law #5068 "On Amendments of Certain Laws of Ukraine regarding the Procedure for Election (Appointment) of Members of the High Council of Justice and Activities of Disciplinary Inspectors of the High Council of Justice" taking into account the proposals of the business community and the recommendations of the Venice Commission, aimed at ensuring the proper formation and operation of the Ethics Council, one-time evaluation of existing members of the HCJ and election (appointment) of new ones.
