The Arzinger team successfully defended the interests of ROUST Ukraine LLC in a labor dispute with a former employee. The case was based on a claim for additional wages and compensation for unused leave. The court of appeal ultimately confirmed that the employer acted in compliance with laws when dismissing the employee.
It should be noted that the case was complicated due to the following factors:
1) the employee's qualification and her knowledge in the field of law (employee - former Head of Legal);
2) the employee's numerous complaints, one of which led to an unscheduled inspection by the State Labour Service;
3) the employee's attempts to bring the dispute into the public domain, with her own biased view of the dispute.
Arzinger's litigation and employment lawyers developed a comprehensive strategy to defend the client (including responding to complaints), represented its interests in court proceedings, prepared the necessary procedural documents, and provided advice on the application of Ukrainian rules of law as well as responding to unreasonable allegations in the public sphere.
Senior аssociate Ievgen Diadiuk and associate Kseniia Lotosh worked on the project under the guidance of counsel Alesya Pavlynska with the general supervision of Sergii Shkliar, partner and head of dispute resolution practice.
