Over a year and a half has passed since the prohibition of mobbing (workplace harassment) was legally established. These changes, intended to protect employees, are often used as additional leverage against employers. The company, management, and direct supervisors are all at risk.

At first glance, many aspects of workplace communication and employer actions can be interpreted as mobbing. For instance, “not being invited to meetings,” “disrespectful treatment," "unequal career advancement opportunities,” “uneven workload distribution,” and “unequal pay” may be classified as mobbing. These concepts are highly abstract and can be interpreted as harassment.

Employee actions can take various forms, from filing complaints with the State Labour Service to establishing instances of mobbing in courts to initiating criminal proceedings.

At the seminar, we will discuss:

  • Court practices and approaches in cases involving the recognition of mobbing incidents;
  • Termination of employees at the employer's initiative due to their engagement in mobbing;
  • Employer's actions during the consideration of complaints at the State Labour Service: the most appropriate defence strategies;
  • Gross violation of labour legislation. Defence in criminal proceedings initiated against the employer.
