Policy Progress: The Antimonopoly Committee Recommended Ukrzaliznytsia to Refine Agreement on Freight Transportation by Railway Transport

On March 26, 2020, the Antimonopoly Committee of Ukraine (AMCU) issued recommendations to Ukrzaliznytsіa to refrain from the implementation of the new Agreement for the provision of services for the organization of freight transportation by railway transport (the Agreement) and to revise the new version of the Agreement with consideration of business community’s position.

Chamber member companies’ experts earlier expressed their concerns about the unequal conditions of the mentioned Agreement and stressed that the implementation of the Agreement should be delayed until the contradictory provisions are resolved. The Chamber addressed Ukrzaliznytsia, AMCU, Ministry of Infrastructure of Ukraine, Cabinet of Ministers of Ukraine with comments and proposals on improvement of the Agreement’s terms. We hope that the AMCU recommendations on the revision of the new version of the Agreement, incl. taking into account the business community’s proposals, will be fulfilled by Ukrzaliznytsia.

The American Chamber of Commerce in Ukraine welcomes the AMCU decision as a lever to protect economic competition on the rail freight market in Ukraine and hopes that the wording of the new Agreement will be improved in the light of the business community’s proposals.
