Policy Win: The Parliament Adopted Draft Law #3438 Unblocking the Environment Impact Assessment Procedure during the Quarantine Restrictions

AmCham Members have consistently supported the adoption of the Draft Law #3438, which foresees temporary amendments to the Law “On Environment Impact Assessment (EIA)” and enables the conduction of planned economic activities in accordance with environmental norms during the COVID-19 restrictive measures.

The EIA process and obtaining an EIA conclusion are prerequisites for ensuring transparency and reliability of planned actions within proposed business programs. However, in light of the current exceptional circumstances caused by COVID-19, including restrictions on movement and public assemblies, the inability to hold public hearings as a part of EIA procedure impeded implementation of EIA and so – performance of planned economic activity.

The Draft Law #3438 amends requirements to public discussions and envisages a shift to remote public discussions for the period of applying the measures aimed at combating the spread of COVID-19, thus avoiding further delays in passing EIA procedure as well as risks of non-performance of planned economic activities.

To keep the business moving and complying with EIA requirements, the American Chamber of Commerce in Ukraine urged Members of Parliament to support Draft Law #3438. This issue was also addressed to the Ministry of Energy and Environmental Protection, inter alia during the AmCham Meeting with Olga Buslavets.
