On June 4 Chamber Members met with Stanislav Shevchuk, Head of the Constitutional Court of Ukraine to discuss current issues in constitutional justice.
In particular, peculiarities of application of recently introduced mechanism of constitutional compliant that allows every citizen to file a complaint regarding constitutionality of the law applied in specific case. As this mechanism was introduced in new edition of Constitution of Ukraine and Law of Ukraine “On Constitutional Court of Ukraine” and there is no judicial practice, representatives of the Chamber Member Companies asked for clarification on how and in which cases this mechanism will be applied, how this function differs from the function of European Court of Human Rights in terms of protection of individual rights and what is a workflow expected.
In his turn, Stanislav Shevchuk outlined his vision of the activities of the Constitutional Court of Ukraine as one of the key bodies in ensuring rule of law in Ukraine. He also noted that there is cooperation between the Constitutional Court of Ukraine and the Supreme Court of Ukraine aimed at ensuring unity of judicial practice.
