On March 14, the Chamber held regular meeting of its Compliance Club devoted to ““Legal Privilege” in FCPA Driven Investigations. Practical Aspects”.
During the meeting, moderated by Yuriy Voytsitskyi, Head of the Chamber Compliance Club, Selepey, Volkovetskyi and Partners, keynote speaker Iryna Nikolayevska, Counsel and Head of Compliance practice at Kinstellar, gave an overview of the notion of legal professional privilege and explained some practical aspects of using legal privilege in FCPA-driven investigations, including such areas as: difference between the concepts of privilege in the UK and the U.S. and difference between the notions of privilege and confidentiality; the role of legal privilege in internal and regulatory investigations; the ways of establishing and preserving privilege; and other related issues.
